Hunter Biden showed up in court for his plea agreement in a large motorcade and secret service protection and tried to intimidate the Judge into approving his plea agreement. Judge Maryellen Noreika would have none of it.

GIULIANI: Remember—this is a JOE BIDEN SCANDAL. This isn't even really about HUNTER as much as JOE used his drug-addicted son to enrich the Biden crime family.

Looks like Hunter’s lawyers and the DOJ structured the “plea deal” on the tax charges to give Hunter [and the Biden crime family] total immunity against all future charges related to being a "foreign agent" or gun violations or money laundering or other treasonous criminality!
The Judge put a stop to that.
Judge Maryellen Noreika denied Hunter Biden's plea deal after she questioned the constitutionality of the immunity Hunter would receive. Looks like Hunter Biden is now going to trial.
The fact that the DOJ and the defense even got to the point where Hunter would be immune from *future* crimes shows that the DOJ is corrupt.
Judge Noreika specifically took issue with the fact that the defense was trying to give Hunter immunity from any charges that would come up in the *future.* When Judge Noreika confronted the prosecutors what Hunter was currently under investigation for, they refused to answer. They also refused to answer if Hunter violated the Foreign Agents Registration Act (FARA.)
WILL SHARF: Based on conversations with people who were in the courtroom today, and my experience as a former federal prosecutor, I think I know the full story of what happened with the Hunter Biden plea agreement blow-up this morning.
Bear with me, because this is a little complicated: Typically, if the Government is offering to a defendant that it will either drop charges or decline to bring new charges in return for the defendant's guilty plea, the plea is structured under Federal Rule of Criminal Procedure 11(c)(1)(A). An agreement not to prosecute Hunter for FARA violations or other crimes in return for his pleading guilty to the tax misdemeanors, for example, would usually be a (c)(1)(A) plea. This is open, transparent, subject to judicial approval, etc.
In Hunter's case, according to what folks in the courtroom have told me, Hunter's plea was structured under Federal Rule of Criminal Procedure 11(c)(1)(B), which is usually just a plea in return for a joint sentencing recommendation only, and contained no information on its face about other potential charges, and contained no clear agreement by DOJ to forego prosecution of other charges.
Instead, DOJ and Hunter's lawyers effectively hid that part of the agreement in what was publicly described as a pretrial diversion agreement relating to a § 922(g)(3) gun charge against Hunter for being a drug user in possession of a firearm. That pretrial diversion agreement as written was actually MUCH broader than just the gun charge.
If Hunter were to complete probation, the pretrial diversion agreement prevented DOJ from ever bringing charges against Hunter for any crimes relating to the offense conduct discussed in the plea agreement, which was purposely written to include his foreign influence peddling operations in China and elsewhere.
So they put the facts in the plea agreement, but put their non-prosecution agreement in the pretrial diversion agreement, effectively hiding the full scope of what DOJ was offering and Hunter was obtaining through these proceedings. Hunter's upside from this deal was vast immunity from further prosecution if he finished a couple years of probation, and the public wouldn't be any the wiser because none of this was clearly stated on the face of the plea agreement, as would normally be the case.
Judge Noreika smelled a rat. She understood that the lawyers were trying to paint her into a corner and hide the ball. Instead, she backed DOJ and Hunter's lawyers into a corner by pulling all the details out into the open and then indicating that she wasn't going to approve a deal as broad as what she had discovered. DOJ, attempting to save face and save its case, then stated on the record that the investigation into Hunter was ongoing and that Hunter remained susceptible to prosecution under FARA.
Hunter's lawyers exploded. They clearly believed that FARA was covered under the deal, because as written, the pretrial diversion agreement language was broad enough to cover it. They blew up the deal, Hunter pled not guilty, and that's the current state of play. And so here we are.
The Hunter Biden plea deal was more outrageous and far reaching than had previously been publicly known. In return for pleading to the two misdemeanor tax fraud charges, with a joint recommendation of no prison time, Hunter was getting not just pretrial diversion on his felony gun charge that would leave his record clear if he completed probation, but also broad guarantees against further prosecution on a wide range of other charges that haven’t been publicly aired as of yet.
Hunter refused to plead guilty without these guarantees, so the judge effectively blew up the plea. Hunter wants to walk away from a decade of criminal activity, including potential FARA violations and other serious criminal charges, with a slap on the wrist. It’s a scandal that Biden’s DOJ was willing to agree to this kind of a deal. Fortunately, Judge Norieka isn’t playing ball.
SUNDANCE: The corrupt U.S. attorney’s office organized, coordinated and colluded with the Hunter Biden team to structure a deal that would provide cover for Hunter Biden for any further crimes. This is corrupt as hell. The judge sniffed this motive and asked the DOJ directly. The DOJ could not make that admission for obvious reasons and denied this intent. Thus, the Hunter defense team then had to say without the previously agreed future immunity, the deal was off.
MATT BEEBE: They were basically trying to give Hunter a pardon without explicitly giving him a pardon. It’s breathtaking how in one moment they weaponize the law to entrap the innocent, and in another moment they fashion a perfectly crafted hole to let certain guilty people free.
Judge Noreika’s life is unfortunately now in peril. She refused to be obsequious to the corrupt DOJ and a HANDMAIDEN to the Biden Crime Family. Let’s hope she is adequately protected.
Immunity for the future takes his sweetheart deal to another level. “Yes, I robbed a bank, and I will plead guilty if you give me immunity for the next one, I rob.” These prosecutors should be reprimanded for that nonsense. Thank Goodness the judge was having none of it.
TOM FITTON: The fix was in for Hunter Biden — until a hero judge stepped up:
"Judge Noreika didn’t have to do much: just ask Hunter Biden’s defense lawyers and the Biden Justice Department prosecutors what, exactly, they had agreed to. The Biden Justice Department didn’t dare say that publicly, so the sweetheart deal went up in smoke."
The Judge questioned why prosecutors had written the plea agreement in a way that gave her no legal authority to reject it. The judge seemed highly skeptical of the "unusual deal" from the get-go, as it offered Hunter Biden BROAD immunity from prosecution in perpetuity. The judge questioned why it was filed under a provision that gave her no legal authority to reject it.
She then asked Leo Wise, the top prosecutor assigned to the case, if there was any precedent for that kind of deal being proposed. He replied, "No, your honor."
Judge Maryellen Noreika then rejected the plea deal and she then threatened to have Hunter Biden arrested if he fails to comply with her release conditions.
HUNTER IS REQUIRED TO: 1) NOT possess a firearm 2) NOT use or possess any controlled substances (including marijuana) unless prescribed 3) Submit to full federal supervision 4) NO use of alcohol AT ALL 5) Seek active employment 6) Submit to testing for prohibited substances 7) Participate in substance abuse therapy PENALTIES FOR VIOLATING COULD INCLUDE: 1) Immediate issuance of an arrest warrant 2) Revocation of release 3) Forfeiture of bond 4) Prosecution for contempt of court
If Hunter consumes alcohol or drugs including marijuana, he will be arrested & be prosecuted for contempt of court. This will almost be impossible for Hunter to avoid - considering he is a career addict.
“Violating any of the foregoing conditions of release may result in the immediate issuance of a warrant for your arrest, a revocation of your release, an order of detention, a forfeiture of any bond, and a prosecution for contempt of court and could result in imprisonment, a fine, or both.”
Now watch - they’ll indict President Trump again to deflect from Hunter’s day in court. The good news? America is getting wise to the scam!
